With regard to your initial points:

1. It is almost certainly true that DIVX is in financial trouble. CC's tactics seem to be getting more and more desperate. In particular I thought it was pretty rich of Sharpe when he announced at WCES how well DIVX players were selling, to omit the fact the "huge" Christmas sales were largely made up of heavily discounted sales to CC employees.

2. I am not generally in favour of boycotts. But what might work is a letter/e-mail campaign. Steve Tannehil over on DVD resource lists the appopriate addresses, courtesy of The Digital Bits web site. The letter/e-mail campaign that Steve initiated when rumours about Walmart getting into bed with DIVX were circulating seemed to be succesful.

If a Blockbuster/DIVX deal does go ahead I hope that those analysing it from BB's perspective really do understand the basic DIVX business model. When they do they will see it is fundamentally flawed, then it will not be worth a row of beans, IMHO. Ah how I would love to be drafting the legal representations and warranties for that agreement, talk about having CC by the short and curlies!!
